DOES THE ATTORNEY GENERAL’S ACT CONSTITUTE AS COMMITMENT OF CRIMINAL OFFENCE??
As we are undoubtedly aware in the case of four Shabelle Media Network Journalists are now in Prison for more than 2 (two) months with no reasonable legal grounds (no Court Verdict). Also the Shutdown of Three Media Stations again have with no legal grounds unless it’s a collective punishments, which amounts unlawful in accordance to internationally recognized standards.
The Attorney General stated publicly and expressly that the Shabelle Journalists are not mistreated during their detention in NISA (Godka Jilaow) whilst all Shabelle detainees consisted of 19 (nineteen) persons had, in fact, witnessed experiences of such ill-treatment including those who are still remaining in prison.
We believe it was not part of his statutory duty to said such statement in public but this should have been announced by an independent fact finding commission with arbitrary status.
In this case we see this as a matter of concealing the truth and obstruction of justice by such a High Profile Person, and it may constitute a criminal offence to undermine the supremacy of law, and allowing to keep the victims in custody for more than 2 (two) months with the absence of court judgment nor even the charges he put on them in Panel Code like 184 High Treason (dead penalty), which only allows to charge someone who serves within the government like Ministers or Military high profile persons who become disloyalty to the State in war times or intended to kill the Head of State. It is quite obvious that all of these scenarios give us space to draw our intention in publicly to see whether there is a possible crime committed within the course of this case.
The popularity of Shabelle Media Network, also known as a hard talker, was probably the causation behind this atrocity in which considerable High Profile Government figures were so annoyed with Shabelle Hard Talk and due to this they lost their patience and consequently come to the conclusion to see Shabelle not to broadcast ever again? and Answer of that was the Announcing of new Attorney General to complete the job done regardless whether its legal or illegal.
It was 26th of October 2013 at the first time when the Government Security Forces had unlawfully invaded Shabelle Media House near International Airport, Opposite Jazeera Hotel, and occupied the Building and destroyed all professional media equipments, with excuse of that the building belongs to Somali Air Lines which never existed since the collapse of Siad Barre’s regime in early 1991 ignoring our lawful possession of the relevant property as a result of formation of legally binding contractual agreement between Shabelle Media v Somalia’s Ministry of Transportation.
After almost one year we know now that Somali Airlines never came in picture in that Building in question even more not existed; so the question is who is violating the supremacy of law and the rule of law??. As a matter of fact, Shabelle Media Network had a valid legal contract with the government legitimizing to remain in exclusive possession of that Premises until 2016.
